Changes in Florida Laws May Impact Your Child Custody Case
Under new laws which become effective in Florida October 1, 2008, many of the
terms which people have grown accustomed to will no longer be used by the
family court. Florida's new laws focus more on the principle of "co-parenting."
Therefore, awarding of "child custody" and "visitation" will cease to exist.

Simplifying Custody and Visitation Changes in Florida 's Parenting Bill
Prior to the enactment of the parenting bill, parental rights were set forth using
terms such as "primary custodial parent" and "non-custodial parent." However,
the new parenting bill has essentially eliminated these terms, including the term
"child custody."
Now, rather than the court awarding one parent custody and the other parent
visitation rights, one cohesive shared parenting plan and time-sharing
arrangement is established. Unless issues of child abuse or neglect or other
pertinent issues are brought to the surface, the presumption is that both parents
share equal interests in raising their children. The shared parenting plan and
time-sharing agreements reflect this equality.
Under the previous visitation model, visitation schedules were allowed to be
vague. However, under the new bill, time-sharing arrangements must be very
detailed so that the arrangement can be better enforced.
